Terms and COnditions

AGREEMENT – This agreement between Mojave Sky Productions LLC (hereafter referred to as “Photographer”) and “Client” governs the assignment, and along with these Terms and Conditions, constitutes the entire agreement between the parties concerning that assignment. The term “Deliverables” refers collectively to Services and Products. The term “Property” refers to the property or properties the assignment concerns.

PAYMENT – Final payment is due upon receiving Deliverables. Late payments will be billed with a $15.00 per month handling fee and 2% interest.

COPYRIGHT – Photographer retains image copyright. Grant of any reproduction rights to Client and Co-Licensee is conditioned upon receipt of payment in full.

LICENSE/USAGE – Client and Co-Licensee may use content in any digital and/or print marketing relating to the sale of the Property. Client is hereby granted a (2) year limited license to use content as it relates to the sale of the Property. Client must obtain additional license to use content as advertising for their own company. Client and Co-Licensee may not license or distribute content to any third parties not listed. Third parties must purchase content licenses from Photographer. Photographer reserves the right to license images to third parties.

CANCELLATIONS, POSTPONEMENTS – In the event of cancellation of shoot upon Photographer’s arrival on site, Client shall pay 50% of anticipated fees.

INDEMNIFICATION: Client hereby indemnifies and holds the Photographer harmless against any and all liabilities, claims, and expenses, including reasonable attorney’s fees, arising from Client’s use of Photographer’s work.
